New York OSHA State Laws:

Chapter 282 of the Laws of 2007, codified as Labor Law 220-h took effect on July 18, 2008. The statute provides as follows: The advertised specifications for every contract for public work of $250,000.00 or more must contain a provision requiring that every worker employed in the performance of a public work contract shall be certified as having completed an OSHA 10 Outreach safety training course.

New York City OSHA Laws:

Both New York State law and New York City code require OSHA Outreach 10 hour cards for employees and 30 hour DOL cards for supervisors on most public construction job sites. The US Department of Labor OSHA Outreach cards on our site are accepted throughout New York and NYC.

A temporary certificate of completion may be printed immediately following the successful completion of the course. You may submit the certificate to your employer and regulatory agencies as proof of your training while you are waiting for the hard copy to be sent to you. You'll receive your US Department of Labor OSHA 10 hour card or 30 hour card by US Mail within four to eight weeks.

OSHA recommends Outreach training program courses as an orientation to occupational safety and health for workers. Workers must receive additional training, when required by OSHA standards, on the specific hazards of the job.

OSHA has issued a new policy that limits all OSHA Outreach training (classroom and online) to a maximum of 7.5 hours training per day in all OSHA Outreach courses. As a result, all 10 hour courses must be delivered over a minimum of two days and all 30 hour courses must be delivered over a minimum of 4 days. In addition, OSHA has also issued a new policy of Program Jurisdiction Restrictions. Outreach training programs are now limited to OSHA Jurisdiction only. Student course completion cards can only be issued for students within U.S. jurisdiction (the 50 States and certain U.S. Territories).

The state of New York Occupational health and safety plan augments or supersedes the Federal OSHA program. The State of New York OSHA applies to government employees, while Federal OSHA applies to Private industry employees. The New York State Plan for Public Employee Safety and Health (PESH), is responsible for promoting the health and safety for more than 2 million State and Local government employees in the State. The New York Department of Labor has been designated as the agency responsible for administering the plan throughout the State.

The Commissioner of Labor has full authority to enforce and administer all laws and rules protecting the safety and health of all employees of the State and its political subdivisions. The PESH Program consists of one central office in Albany, New York and nine district offices located throughout the State: Albany, Binghamton, Syracuse, Utica, Rochester, Buffalo, White Plains, Garden City and New York City.

Jurisdiction

The New York State Plan applies to all public sector employers in the State, including: State, County, Town, and Village governments, as well as Public Authorities, School Districts, and Paid and Volunteer Fire Departments. Federal OSHA maintains jurisdiction over all private sector workplaces; federal agencies; maritime employers such as shipyards, marine terminals, and longshoring; military facilities; Indian sovereignty workplaces; and the U.S. Postal Service.
